That the Municipality of West Perth Committee of Adjustment APPROVE Minor Variance 03-2022 submitted by Shayne Ahrens on behalf of Ham Land Acres Ltd. affecting lands described as Lot 2 Concession 6 (5056 Line 26), Fullarton Ward, Municipality of West Perth and that the Committee hereby grants the following variance to Zoning By-law 100-1998: 1) Section 6.4.1 – Livestock facilities shall comply with the Minimum Distance Separation formula II (MDS II). The proposed livestock housing facility would have an MDS II setback of 154.8 metres from a residential use located at 5055 Line 26, as based on the submitted application; and The subject application conforms to the general intent and purpose of the County of Perth Official Plan and the Municipality of West Perth Zoning By-law. The subject application has also been found to be desirable for the appropriate development or use of the subject property, and is minor in nature. The following conditions are to apply: 1) That the Minor Variance only applies to the proposed livestock housing facility consistent with the application; and, 2) That the owners obtain the necessary Building Permit within two years of the approval of the Minor Variance.
