That the Municipality of West Perth Committee of Adjustment APPROVE Minor Variance Application D13-02-19 to permit relief from Section 8.2.5 (a)(ii) of the Municipality's Zoning By-law to allow a minimum interior side yard on one side of 1.5 metres (approx. 4.92 ft.) and at least 2.4 metres (approx. 7.9 ft.) on the other side, whereas the Zoning By-law requirement is 6 metres (19.69 ft.) on one side and 1.5 metres (4.92 ft.) on the other side; and That the approval shall be subject to the following conditions: That the owner/applicant obtain the necessary Building Permit within 8 months from the date of decision to the satisfaction of the Chief Building Official, ensuring that the approved variance applies only to the raised deck structure as illustrated with the application; and, That the owner/applicant obtain within 5 months from the date of decision the necessary survey prepared by a qualified O.L.S. that confirms: The minimum side yard between the raised deck and the easterly side lot line is not less than 1.5 metres; and, The minimum side yard between the dwelling and the westerly side lot line is not less than 2.4 metres.
